VSO Meeting

November  20-21, 2002

Resort Suites - Scottsdale, AZ

Elwood Parsons, VSO Chair, called the meeting to order and asked members to introduce themselves.  After introductions the agenda was reviewed and several additions were made.  The minutes from the July and September meetings were approved as written.  Elwood asked for announcements.

No announcements were made.

John Rynearson, VITA, presented the ANSI and VSO patent policy and called for patent disclosures.

Eric Nickerson, Teradyne, noted that United States patent number 6,379,188 owned by Teradyne contains intellectual property (IP) as demonstrated in the 2mm HM ZD connector manufactured by Tyco and ERNI.  Eric noted that licensing agreements currently in place with Tyco allow Tyco to use this technology and to provide this technology to one other company.  However, Eric stated that neither Tyco nor ERNI can license Teradynešs IP on RAND terms to other companies as was stated in the Tyco and ERNI letter to VITA regarding their willingness to license the HM ZD connector to others on RAND terms as required by ANSIšs patent policy.

Elwood Parsons, representing Tyco, stated that Tyco was not responsible for the claims of other companies regarding Tycošs willingness to license its IP.

John Rynearson gave a presentation reviewing ANSIšs patent policy and how to determine what is an essential patent.

The membership discussed this issue and upon motion duly made, seconded, and approved, asked Teradyne to state its position on its willingness to license the technology contained in United States patent number 6,379,188 on RAND terms.
